The foundation of British justice is the principle that no one, not even the state, is above the law. Court orders are not mere suggestions; they are the binding commands of a sovereign judiciary, and it is the solemn duty of public servants to give them effect. When a state official deliberately chooses to ignore these commands, they are not just engaging in a bureaucratic dispute; they are actively undermining the rule of law itself.

This is precisely the disturbing situation that has come to light with the actions of Richard Hill [Below], an Assistant Land Registrar at HM Land Registry. In a shocking display of judicial overreach, Hill has unilaterally challenged and refused to act on a series of lawful court orders related to the property at 7 Winnington Close, Hampstead.

The facts, now a matter of public record, are stark. The State of Libya, a party to the original dispute, has explicitly admitted to a fraud on the court. This admission, based on fabricated evidence provided by a former lawyer, led directly to a series of consent orders from both Deputy District Judge Britlin and His Honour Judge Gerald.

These orders were not about re-litigating a settled matter but about rectifying a grave injustice acknowledged by the party that perpetrated it. They were clear, detailed, and legally sound: the title to the property was to be vested in its true owner, Capitana Seas 2008 Trust.

Yet, Richard Hill, a public servant whose role is to register, not to question, these orders, has rejected them. In his letter, Hill dismisses the orders as "not credible," asserting that a County Court cannot "overturn the clear findings" of the High Court. This stance is a fundamental misinterpretation of legal procedure. The court orders in question were not an attempt to overturn a previous judgment, but rather to give effect to a new judicial truth that emerged from an admission of fraud.

By substituting his own legal opinion for that of a judge, Hill has effectively appointed himself as a higher court of appeal. This is a profound and dangerous abuse of his position as a public servant. The Land Registry is a servant of the law, not its arbiter. Its function is to uphold and execute the law, not to second-guess the decisions of judges based on subjective and uninformed assertions.

The consequences of this blatant refusal to act are dire. It enables a continued fraud against the rightful owners of the property and subjects them to ongoing legal battles and financial hardship. It also threatens to bring the Land Registry into disrepute, opening the door for legal sanctions, including a mandatory injunction to compel compliance and a claim for damages against the institution.

The actions of Richard Hill are not merely a procedural misstep; they are a direct assault on the very system he is employed to protect. This case stands as a chilling reminder that the rule of law is not self-enforcing. It requires constant vigilance and unwavering integrity from those in positions of public trust. When that trust is betrayed, the entire system is at risk.
